BRASILIA, Nov. 10 (Xinhua) -- Brazilian Justice has ordered on Monday the company Google to pay compensation of 850,000 reais (500,000 dollars) to Formula 1 driver Rubens Barrichello because of a fake profile on relationship site Orkut, reported on Tuesday the local press.
The value of the penalty, taking into account the interests since the prosecution was initiated, in July 2006, reached 1,200,000 reais (706,000 dollars).
If the company fails to comply with the injunction requiring removal of content from the online social network, Google will suffer a daily fine of 1,000 reais (590 dollars).
It said to exist today about 300 fake profiles of the Brazilian pilot on Orkut, according to Barrichello, in addition to several communities that allude to his name.
The pilot stated in the process that he had formally asked Google in 2006 to remove the insulting profiles and communities, but the company would have acted with "total contempt".
Google Brazil said that it is not the author of the offense and disclaims responsibility with respect to content created by its Orkut users.
The ruling notes, however, emphasize that the "responsibility to the required is undeniable, since it offers space for all types of posts, which creates a usage policy, with rules laid down" and that it is up to Google to remove pages, as technology holder.
According to experts, if the decision is not reversed on appeal, this will be the largest damages awarded in Brazil in cases of fake profiles on the Internet.
