BEIJING, Oct. 19 (Xinhuanet) -- Anna Nicole Smith's former lawyer and companion filed court papers in Los Angeles Superior Court seeking to establish her 13-month-old daughter as the sole heir of the late model's estate, media reported Friday.

Smith's will was drafted long before the birth of her daughter, Dannielynn, in September 2006. The former playboy model died of drug overdose on Feb. 8 before updating the will to include her daughter.

The will, filed in May, left all her assets to her son, Daniel, who was her only child at that time. He died three days after Dannielynn was born.

In court papers filed Thursday, Howard K. Stern states that "although (Anna Nicole) did not expect to have any children in the future, if she did, she wanted them to share equally in the trust created for Daniel."¡¡

Dannielynn is now in the custody of her father, Larry Birkhead, who was established as her parent through DNA testing that settled a legal dispute with Stern.

Smith's assets were estimated at 710,000 U.S. dollars, but as the widow of Texas oil tycoon J. Howard Marshall II, she had been fighting Marshall's family for years over his estimated 500 million dollars fortune.

How much of that money, if any, eventually goes to Dannielynn could depend on the outcome of the legal dispute.
