¡¡¡¡The Ministry of Foreign Trade and Economic Cooperation (MOFTEC) announced an anti-dumping investigation on imported Polyvinyl Chloride originating in USA, the Republic of Korea, Japan, Russia and as well as the Taiwan region in its notice on March 29, 2002.

¡¡¡¡MOFTEC and State Economic and Trade Commission have made investigation separately on dumping and the range of dumping, damage and the degree of damage to China¡¯s industries.

¡¡¡¡Approved by First Conference of Tenth National People¡¯s Congress, the Ministry of Commerce has carried out anti-dumping investigation. According to the investigation, Ministry of Commerce issued a notice of original arbitration on May 12, 2003, announcing that the dumping of the investigated products had taken place and it had caused substantive damage to China¡¯s industries and there was a direct causal relationship between the dumping and damage.

¡¡¡¡According to further investigation and Anti-dumping Regulations of the People¡¯s Republic of China, the Ministry of Commerce made final arbitration.

¡¡¡¡It confirmed that the dumping of the investigated products had taken place and it had caused substantive damage to China¡¯s industries and there was a direct causal relationship between the dumping and damage.

¡¡¡¡Tariff Commission of the State Council decided to levy anti-dumping tax on Polyvinyl Chloride exported to China from above countries and region as of September 29, 2003. The product is Polyvinyl Chloride listed under No. 39041000 in import tariffs of the General Administration of Customs of the People¡¯s Republic of China.

1. Shintech Incorporated: 83%
2. Formosa Plastics Corporation Texas£º11%
3. All others: 83%

Companies of the Republic of Korea
1. LG CHEM, LTD£º6%
2. Hanwha Chemical Corporation£º12%
3. All others: 76%

Japanese Companies
1. Shin-Etsu Chemical Co., Ltd.: 17%
2. V-Tech Corporation: 21%
3. Taiyo Vinyl Corporation: 7%
4. Shin Dai-Ichi Vinyl Corporation: 34%
5. Kaneka Corporation: 30%
6. All others: 84%

Russian Companies:
1. J/S Co. Kaustik: 34%
2. All others: 47%

Companies of Taiwan Region:
1. China General Plastics Corporation: 12%
3. Formosa Plastics Corporation: 10%
4. Taiyo Plastics Corporation: 22%
5. All others: 25%

¡¡¡¡Joint Stock Company (SAYANSKCHIMPLAST) signed a price agreement on September 27, 2003, which went into effect on September 29. The rules of the price agreement apply to Joint Stock Company.

¡¡¡¡The importers should pay relevant anti-dumping tax to the General Administration of Customs of the People¡¯s Republic of China as of September 29, 2003 for a period of 5 years when they import the product mentioned above.

¡¡¡¡There are also some regulations on backdate levying of anti-dumping tax, new importers reexamination, interim review and administrative reconsideration and lawsuit. Enditem (mofcom.gov.cn)
