The Ministry of Foreign Trade and
Economic Cooperation (MOFTEC) announced an anti-dumping investigation into
phenol imported from Japan, Republic of Korea, USA and as well as the Taiwan
region (investigated product) in its Notice No.35 on Aug. 1, 2002. The
investigated product is listed under No. 29071110 in the 2002 import tariffs of
the General Administration of Chinese Customs.
MOFTEC and State
Economic and Trade Commission have made investigation separately on dumping and
the range of dumping, damage and the degree of damage to China¨s industries.
Approved by First Conference of Tenth National People¨s Congress, the
Ministry of Commerce has carried out the anti-dumping investigation. According
to the investigation and Anti-dumping Regulations of the People¨s Republic of
China, Ministry of Commerce made original arbitration as follows:
The
Ministry of Commerce confirmed that dumping of the investigated product had
taken place, the investigated product had caused substantive damage to China¨s
industries and there was a direct causal relationship between the dumping and
the damage.
The dumping range of related companies is as follows:
Japanese Companies: 4. Mitsui Chemicals, INC. Japan: 7% 5. All
others: 144%
Companies of Republic of Korea: 1. Kumho P&B
Chemicals, INC. South Korea.: 10% 2. All others: 10%
All USA
Companies: 29%
Companies of the Taiwan Region: 1. Formosa Chemicals
& Fibre Corporation Taiwan: 7% 2. Taiwan Prosperity Chemical Corporation
Taiwan: 10% 3. All others: 20%
According to Article 28 and 29 of
Anti-dumping Regulations, the Ministry of Commerce has decided to take temporary
anti-dumping measures in cash margin. Importers should pay relevant cash margin
to the Customs of the People¨s Republic of China according to above range of
dumping when they import the investigated products from above countries.
Related interested parties can provide written comment and related
evidence in 20 days after the Notice is issued. The Ministry of Commerce will
